Durham Inadequate Security Lawyers

Lawyers for Inadequate Security Claims in Raleigh-Durham, NC

If you or a family member have been violently attacked, you may have a claim against the person who committed the violent act and the owner of the property where the attack occurred.  An assault, rape, shooting or other violent act can happen at any property open to the public if the property owner doesn’t take care to protect the people who are invited on the premises. If a tragedy does occur, an assault lawyer can investigate to see whether the property owner may be responsible for paying your medical bills, lost wages, and pain and suffering.

All property owners should be aware of the risks associated with their particular businesses. Some businesses are riskier than others. Also, some business owners choose to locate their businesses in high-crime areas but don’t take adequate precautions to protect the people they invite on the premises. If a property owner fails to take reasonable care to keep the public safe, the owner can be liable for the injuries or death suffered by his customers. Our assault victim attorneys are experienced in bringing claims and lawsuits against business owners responsible for injury or death because of inadequate security.

Getting help

If you or a family member has been the victim of a violent attack, you should notify law enforcement immediately and also seek immediate medical treatment. In the event of a rape, it is extremely important to notify law enforcement right away. When seeking medical treatment, obtain and preserve all evidence necessary to prove the rape. It is very important to call an assault lawyer right away. Our assault lawyers can help make sure that the evidence is preserved, and that your rights are protected. We have information about the rights of crime victims that we will share with you. We can help you deal with the media in case they are asking you for a statement or a response.

A person injured in a violent attack will usually benefit from trauma intervention and counseling. Many communities now have response and recovery plans in addition to crime prevention efforts. The Office for Victims of Crime has many resources for victims of crimes, including victims of terrorism and mass shootings. The National Center for Victims of Crime also has resources, including a description of options for seeking justice through the criminal and civil justice system.

Samples of inadequate security cases our lawyers have handled:

The following is a sample of cases handled by our shooting victim lawyers for victims of assault, rape, shootings and other violent attacks:

A convenience store clerk was shot by an armed robber. Doctors at Duke University Medical Center managed to save his life. We filed a lawsuit against the owner of the convenience store, claiming that the store, which was part of a franchise, had inadequate security policies which led to the shooting. We also brought workers’ compensation claims against the man’s employer. The personal injury case was resolved. The workers’ compensation case went to the North Carolina Supreme Court.

A 77-year old woman living in a retirement community was severely beaten by the housekeeper of the couple who lived next to her in a retirement community. Her skull and hands were fractured, and she suffered a brain injury. Two others were killed in the attack. After the crime took place, people discovered that the housekeeper had a criminal record. We filed suit, saying that the retirement home failed to enforce its own policy of requiring background checks on employees of residents. The case was resolved confidentially.

A bank teller was hit in the head with the butt of a rifle during an armed robbery at her place of employment. The perpetrator also shot the gun next to her ear, causing permanent hearing damage. We brought a workers’ compensation case and provided evidence that the employee was permanently and totally disabled as a result of the attack.

A motel guest was shot in an armed robbery, and the incident left him permanently disabled. Our expert discovered after the incident that the motel’s owners knew that criminals were hanging around the premises, but they took no special action to keep them away. The case was resolved before the trial date.

Please contact our assault victim lawyers if you or a loved one has been the victim of a crime and you believe someone else may be responsible.

It is important to act quickly because there is evidence to be gathered and there are legal deadlines that may prevent you from filing a lawsuit if you wait too long.
